Brett Trout The New Guidance Update The United States Patent and Trademark Office (USPTO) has just released its 2024 Guidance Update on Patent Subject Matter Eligibility, Including on Artificial Intelligence (AI). These new guidelines took effect July 14, 2024. The USPTO issued this guidance update on patent subject matter eligibility to address innovation in critical and emerging technologies, especially AI.
This is a FOSTA case. It reached the 9th Circuit on personal jurisdiction grounds. The 9th Circuit held that some foreign defendants were subject to jurisdiction. On remand, the court dismisses the remaining defendants primarily due to Section 230, with leave to amend. The court summarizes the facts: Plaintiff alleges she was trafficked as a minor and her traffickers filmed her while she was engaged in sex acts.
